Abstract

From the ancient time, war was recognised as a legal act. It could be resorted to by the states as a means of self-help or as on ultimate means for the settlement of disputes. It was within the power of a state to gain advantage over another by the direct recourse to war. International law did not consider was as an illegal act. And so the Hague and other convention formulated elaborate rules of war and peace : These conventions were mostly customary laws but for the first time set out as multilateral agreement.
