Abstract

India has neither signed nor ratified the Rome Statute (‘Statute’) of the International Criminal Court (‘ICC’). It actively participated in the Preparatory Committee for the Establishment of International Criminal Court (‘Prep Com’) and the United Nations Diplomatic Conference of Plenipotentiaries on the Establishment of an Internation¬al Criminal Court (‘Rome Conference’), however, India abstained from the motion to adopt the Statute at the con¬clusion of the conference. This policy brief studies the positions taken by India in the Prep Com and the Rome Conference, identifies the primary reasons for India’s abstention, and analyses their context and merit.
