BUSINESS FROM FAKE TRADEMARK - OPPOSING THE BUYER BEWARE (CAVEAT EMPTOR) PRINCIPLE IN INDIA

Abstract

This article attempts to study the buyer beware principle; the concept carried out the buyer could not recover damages from the seller for defection, the property that rendered the property unfit for ordinary purposes. The only exception was if the seller actively concealed latent defects or otherwise made material misrepresentations or fake trademarks practice amounting to fraud or offensive one under the law. It maps the implication of such principle on the natural contract and consumer protection right scenario.
